These Terms and Conditions apply to memberships, open gym access, group training, personal training, events and other services provided by HTT.
By purchasing a membership or service, creating an account, registering for a session or using HTT premises, the customer agrees to these Terms and Conditions.
1. Membership
HTT memberships are personal and may not be transferred, shared or used by another person.
Members must be at least 18 years old.
The services included in each membership are described at the time of purchase.
Members are responsible for providing accurate information and keeping their account and contact information up to date.
2. Monthly membership and automatic renewal
HTT memberships are monthly memberships and automatically renew each month using the selected payment method.
The applicable membership fee is charged automatically on each renewal date.
There is no minimum commitment period unless explicitly stated for a particular product.
Members may cancel their membership at any time without a notice period. Cancellation prevents the next automatic renewal. The membership remains active until the end of the period already paid for.
Membership fees for an already commenced membership period are not refunded solely because the member chooses not to use the gym, without prejudice to any mandatory rights provided by law.
HTT does not currently offer membership freezes or pauses.
3. Founding 50 Membership
The Founding 50 Membership is a limited membership available only to customers accepted by HTT as Founding Members.
The Founding Member price remains available for as long as the member maintains their membership continuously.
If a Founding Member cancels their membership, the Founding Member price and status are lost. If the person later rejoins HTT, the membership prices and conditions available at that time will apply.
The Founding Membership is personal and cannot be transferred to another person.
4. Payments and failed payments
Membership fees must be paid by the applicable due date. For memberships managed through an IronTrack contract, HTT will send the member a payment link by email before each monthly payment due date.
If payment is not received by the due date, HTT may suspend gym access, class booking and other membership privileges until the outstanding payment has been received.
Access and membership privileges may be restored once payment has been successfully completed.
5. Online purchases and 14-day withdrawal right
Where a membership or service is purchased online, consumers generally have a statutory right to withdraw from the distance contract within 14 days from conclusion of the contract.
Where a customer wishes to begin using HTT services during the 14-day withdrawal period, HTT may request the customer's express request for the service to begin immediately.
If the customer subsequently exercises their statutory withdrawal right after requesting that the service begin, HTT may charge an amount proportionate to the services already provided, where permitted by law.
Nothing in these Terms limits any mandatory consumer rights.
6. Class bookings and cancellations
Where advance booking is required, members are responsible for managing their own class bookings.
A class must be cancelled at least 2 hours before its scheduled starting time to avoid being recorded as a late cancellation.
Failure to attend a booked class without cancelling is considered a no-show.
If a member accumulates three late cancellations and/or no-shows within a rolling 30-day period, HTT may suspend their ability to book classes for 7 days. This restriction does not automatically cancel the member's membership. HTT may reasonably change instructors, class formats and schedules or cancel classes due to circumstances such as instructor illness, emergencies, technical problems or other operational reasons.
7. Open gym and unstaffed access
HTT provides open gym access, including periods during which no HTT coach or staff member may be physically present.
Members using the gym during unstaffed hours understand that immediate staff assistance may not be available.
Members must exercise within their abilities and should not perform exercises or use equipment that they cannot safely perform or operate independently.
In an emergency, members must contact emergency services by calling 112.
Electronic access credentials are personal and may not be shared or used to provide access to another person.
Members must ensure that unauthorised persons do not enter the premises using their access credentials.
8. Health and participation
Physical exercise, particularly running, strength training, functional fitness and high-intensity exercise, involves inherent risks.
These can include falls, collisions, strains, sprains, musculoskeletal injuries and cardiovascular stress. Such risks cannot be completely eliminated even when reasonable safety precautions are taken.
Members are responsible for exercising within their abilities.
Members must inform the coach before participating in a coached session of any injury, health condition, physical limitation or other circumstance that may materially affect their ability to participate safely.
Anyone uncertain whether exercise is appropriate because of their health should obtain appropriate medical advice before participating.
Members should stop exercising and seek appropriate assistance if they experience concerning symptoms such as chest pain, fainting, severe dizziness, unusual shortness of breath or other significant symptoms.
A participant may stop or decline an exercise at any time.
9. Coaching and instructions
Members must follow reasonable safety instructions provided by HTT coaches and staff.
Exercises may be adapted according to ability, experience and individual circumstances.
Information and coaching provided by HTT are intended for fitness and educational purposes and do not constitute medical diagnosis or medical treatment.
10. Equipment and safety
Members must:
● use equipment only for its intended purpose;
● follow instructions concerning equipment use;
● not use equipment they do not know how to operate safely;
● maintain reasonable awareness of other people training nearby; and
● immediately report damaged, defective or potentially unsafe equipment.
Equipment identified as defective or unsafe must not be used.
11. Conduct
HTT aims to provide a safe and respectful training environment.
Aggressive, threatening, discriminatory, harassing or deliberately dangerous behaviour may result in removal from the premises and/or suspension or termination of membership.
HTT may also suspend or terminate access in cases of serious or repeated safety-rule violations, intentional property damage, unauthorised access sharing or repeated failure to pay membership fees.
HTT will exercise these rights reasonably and in accordance with applicable law.
12. Personal belongings
Members are responsible for their personal belongings.
Members should not leave valuable items unattended.
HTT's liability for loss, theft or damage to personal property is determined in accordance with applicable Estonian law.
13. Liability and acknowledgement of risk
Acknowledgement of risks and participant responsibility
Members understand and accept that physical exercise, including strength training, running, functional fitness, HYROX training and other high-intensity exercise, involves inherent risks of accident and injury that cannot be completely eliminated even when exercises are performed correctly and reasonable safety precautions and coaching are provided.
These risks may include, among others, muscle strains, sprains, joint or back pain, falls, collisions, overuse injuries, and the aggravation or manifestation of previously known or unknown health conditions or injuries.
Members are responsible for exercising within their abilities, following reasonable instructions provided by HTT staff and coaches, and using equipment only for its intended purpose and in accordance with instructions.
Members must inform the coach before a coached session of any known injury, medical condition, physical limitation or other circumstance that may materially affect their ability to participate safely.
Members must not deliberately misuse equipment, disregard safety instructions, interfere with other members' training or engage in conduct that creates an unreasonable risk to themselves or others.
During unstaffed Open Gym periods, members are responsible for selecting exercises, loads and equipment that they can safely perform and use independently. Members should not
attempt exercises or use equipment that they do not know how to perform or operate safely.
Liability
HTT will provide its services with reasonable care and take reasonable measures to maintain safe premises and equipment.
HTT is not responsible for an injury merely because the injury occurs while a member is training at HTT or participating in an HTT session.
HTT is not responsible for injury, loss or damage resulting from the inherent risks of physical exercise, a member's undisclosed known health condition or injury, failure to follow reasonable safety instructions, deliberate or improper misuse of equipment, unauthorised use of the premises or equipment, or exercise undertaken independently during Open Gym, except to the extent that the injury, loss or damage results from an act or omission for which
HTT is legally responsible.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under Estonian law.
14. Accidents and emergencies
HTT maintains accessible first-aid equipment on the premises.
In the event of an accident or medical emergency, persons present should seek appropriate assistance and contact emergency medical services by calling 112 where necessary. First aid may be provided within the person's knowledge and ability until professional medical assistance is available.
Members must report accidents, injuries, unsafe conditions and damaged equipment to HTT as soon as reasonably possible.
15. CCTV and access control
For security and safety purposes, HTT uses CCTV and electronic access control.
The processing of CCTV recordings and access data is described in the HTT Privacy Policy.
CCTV is never used in toilets, showers or changing areas.
16. Changes to services
HTT may reasonably modify opening hours, class schedules, instructors, equipment or services where necessary.
Where a material change affects the essential characteristics or price of a member's contract, HTT will provide appropriate advance information and respect applicable consumer rights.
17. Complaints and governing law
Questions or complaints should first be sent to hybridtrainingtallinn@gmail.com so that HTT has an opportunity to resolve the matter.
These Terms are governed by Estonian law.
Nothing in these Terms limits the mandatory rights available to consumers under Estonian or applicable European Union law.
